All parties were already suing each other, and the art needed to be sold in a way that avoided further litigation.

The trustee was faced with a situation where there was litigation between 3 of the parties involved within the structure, and as the structure was ‘dry’, the art collection needed to be sold to fund the litigation. However all parties had their own ideas on how they wanted to sell the collection, leading to a lack of trust between the parties on a way forward.

Cadell’s tender process allowed all parties the level of transparency, professionalism and impartiality that the situation required. The collection was sold successfully over a 6-month period without any further litigation between parties.
